ADA/Title VI Complaint Procedure

City of Homer Complaint Procedure under 

Title II of the Americans with Disabilities Act of 1990 (ADA) and

Title VI of the Civil Rights Act of 1964

 

The City of Homer has established this “Complaint of Discrimination” Procedure to review and resolve allegations of discrimination. This procedure applies to complaints filed under Title VI of the Civil Rights Act of 1964 (Title VI) and Title II of the Americans with Disabilities Act (ADA) which prohibit discrimination based on race, color, national origin (including Limited English Proficiency), and disability in any program or activity administered by the City of Homer or its subrecipients, consultants and/or contractors.

This complaint procedure may be used by anyone who wishes to file a complaint alleging violation on the basis of a legally protected group in the provision of services, activities, programs or benefits by the City of Homer.  The City’s Personnel Policy governs employment-related complaints of violation. 

The complaint should be in writing and contain information about the alleged violation including name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint will be made available for persons with disabilities upon requestThe Complaint form can be found here: ADA/Title VI Complaint Form.

The following timeline is established in accordance with ADA and Title VI. It is the goal of the City of Homer to discuss and resolve grievances as quickly as possible. 

1. The complaint should be submitted by the complainant and/or their designee as soon as possible but no later than 180 calendar days after the alleged violation to:

2. The ADA/Title VI Coordinator or designee will meet with the complainant within 15 calendar days after the receipt of the complaint to discuss the non-compliance and possible resolutions. 

3. The ADA/Title VI Coordinator or designee will respond in writing, and where appropriate, in a format accessible to the complainant, within 15 calendar days. The response will explain the position of the City of Homer and offer options for substantive resolution of the complaint. 

4. If the response of the ADA/Title VI Coordinator or designee does not satisfactorily resolve the issue, the complainant and/or their designee may appeal the decision to the City Manager or designee within 15 calendar days after receiving the response. Failure to appeal within this period shall be interpreted as acceptance of this resolution.

5. The City Manager or designee will meet with the complainant within 15 calendar days of receiving the appeal to discuss the complaint and resolution. 

6. The City Manager or designee will respond in writing, and where appropriate, in a format accessible to the complainant, within 15 calendar days with a final complaint resolution. 

 

All written complaints received by the ADA/Title VI Coordinator or designee, appeals to the City Manager or designee, and responses from these two offices will be retained by the City of Homer for at least three years.

A complaint may be dismissed if the complainant requests the withdrawal of the complaint; the complainant does not respond to requests for information on or before the date indicated in the request; or the complaint is not timely filed. 

You are under no obligation to follow the City of Homer Complaint Procedure before filing a formal complaint with appropriate State or Federal agencies. The City of Homer Complaint Procedure is an informal process designed solely for the purpose of promptly and fairly resolving an ADA/Title VI complaint with the city.
