Subject: Credit for Previously Paid Water Assessments
Eric Lane/Lillian Walli Subdivision Road and Sewer Project
The property owners in the Lilian Walli Subdivision, in November of 1988, were assessed $1,499.46 sewer and water assessments for the Sterling Highway water and sewer improvements. These improvements did not provide any service to the Lillian Walli Subdivision. Why these property owners were assessed is unknown, but a good argument can be made that they should not have been assessed for improvements that did not directly benefit them.
The Council approved Resolution 15-048(S), which did note that “previously paid sewer assessments will be credited to back each property owner at the time the proposed Lilian Walli road and sewer assessments are levied”.
The property owners feel they should receive credit for the previously levied water assessments.
Recommendation: City Council pass a resolution noting that the amount of previously paid water assessments will be credited to back each property owner within the assessment district at the time the proposed Lillian Walli road and sewer assessments are levied.
